MSU Introduces State 'Stand-Ins' for 2020 Seasons

Mississippi State Athletics is offering fans the opportunity to attend events in a different manner this season at Davis Wade Stadium, the Newell-Grissom Building, and the MSU Soccer Field with State Stand-Ins. Cutouts will range in price from $30-$150.

State Stand-Ins are available now at MaroonMemories.com and fans have until Monday, September 21 to place their orders and ensure their cutout is in place for the first home events of the season. There are limited quantities of each package so don't wait too long.

Terms & Conditions – Release, Waiver, and Indemnity
This release, waiver and indemnity (this "Release") is made to grant Mississippi State University (referenced herein as "Mississippi State Athletics")Â the right to use a photographic image of myself or my child(ren) or ward(s) (collectively, "Minor(s)") and/or other featured individuals (together with me and Minor(s), "Featured Individuals") (the "Image(s)") for the purposes of reproducing, altering, printing and placing the Image(s) in seats at Davis Wade Stadium, the Newell Grissom Building, and the MSU Soccer Field such that the Image(s) is/are visible to those at these locations and the audience viewing Games (as defined below) at these locations via television or other media (the "State Stand-Ins"). I am giving this Release in consideration for Mississippi State Athletics allowing me and/or other Featured Individuals to participate in the Mississippi State Athletics State Stand-Ins (the "Program"), and the possibility of the Image(s) appearing in a visual production(s) (collectively, "Production").

I hereby expressly grant the Mississippi State Athletics the right to use the Image(s) and the State Stand-Ins, including Featured Individuals' Personal Information (as defined below). I have submitted to Mississippi State Athletics the image, likeness, and appearance as they appear in the State Stand-Ins, in connection with the Program or other games ("Games") broadcasts, rebroadcasts, programming or commercials, stadium features, internet commercials and/or other media (collectively, the "Media") now known or hereafter created for the purpose of displaying Games or clips thereof and advertising, marketing and/or promoting the Mississippi State Athletics, Games or these locations. I also grant Mississippi State Athletics the right to include in the Production, separate and apart from the Image(s), Personal Information of each of the Featured Individuals that I am voluntary submitting to Mississippi State Athletics (the "Submitted Information"). I hereby assign to Mississippi State Athletics all worldwide right, title and interest in or to the Image(s) that I am voluntarily submitting to Mississippi State Athletics and/or that are captured through technology provided to me by Mississippi State Athletics, including, but not limited to, all trademarks, copyrights and other intellectual property rights in and to the Image(s) and the likeness, image, name, biographical information and/or other attributes (collectively, "Personal Information") of the Featured Individuals (collectively, "Image Rights"). I further agree that the rights granted hereunder shall include the right of Mississippi State Athletics to depict, telecast, cablecast, publish, distribute, record, digitize, modify, alter, edit, adapt, create derivative works, display, publicly perform, exhibit, transmit, broadcast, rerun, reproduce, sell, rent, license, otherwise use, or otherwise exploit the Image(s), State Stand-Ins and Submitted Information in perpetuity in any Production in any medium currently existing and hereafter developed (including, without limitation, to incorporate the Image(s) and/or any derivative works into broadcasts of Games or clips of Games distributed via television, YouTube and/or other -related social media platforms ("Social Media Platforms"), subject to the applicable Social Media Platform's terms of service and privacy policy), on the internet and other digital transmission or delivery methods and non-broadcast/industrial uses in whole or in part, for commercial purposes, exploitation, the purpose of trade, promotion, advertising, public relations, publicity, packaging, and/or otherwise without notification or payment of any compensation to me or the other Featured Individuals, or our heirs, legal representatives, successors and assigns or approval rights for the use of the Image(s) or Submitted Information, except where prohibited by law. Nothing herein shall constitute any obligation by Mississippi State Athletics to make use of the Image(s).

I certify, represent and warrant that (a) I am the exclusive owner of all Image Rights or have authorization from all rights holders, with the right to edit and modify such Image(s) in my discretion, (b) I have the express permission of all Featured Individuals other than Minor(s) to submit the Image(s) and Submitted Information to Mississippi State Athletics and agree to this Release on their behalf, and I am the legal guardian of the Minors, have the legal authority to submit the Image(s) and Submitted Information of the Minor(s) to Mississippi State Athletics and agree to this Release on their behalf, (c) the use of the Image(s) and Submitted Information does not require further approval from me or approval by any third party to be used in connection with the Program, any Production or in any Media for the purposes described in this Release, (d) Mississippi State Athletics shall be without liability to me, the other Featured Individuals or our heirs or personal representatives for any distortion or illusionary effect resulting from the exhibition, publication, or other use of the rights granted herein, and (e) I am 18 years or older and this Release does not conflict with any existing commitments on my part.

I hereby (i) expressly release, discharge and waive all claims, demands, losses and liabilities of any nature which may arise from or relate to, and (ii) covenant not to make any claims against Mississippi State Athletics and each of their respective parents, affiliates, subsidiaries and advertising and promotion agencies, and each of their respective officers, directors, employees and agents (collectively, the "Released Parties") as a result of, the exploitation of the rights granted hereunder or dissemination or use of the Image(s), the State Stand-Ins, the Submitted Information or their use in any Production or Media. "Mississippi State Athletics " shall mean the Mississippi State University, and the other and such respective past, present and future officers, employees, agents, representatives, the Board of Trustees of State Institutions of Higher Learning of the State of Mississippi and its members. Additionally, I hereby agree that I will indemnify and hold harmless the Released Parties and their respective agents (collectively, the "Indemnified Parties") from, and, if requested, shall defend them, without cost to the Indemnified Parties, against any and all third party claims (including reasonable attorneys' fees), with respect to injury of any and every nature whatsoever and in any manner arising directly or indirectly out of my submission of the Image(s) and the Submitted Information, my certifications, representations and warranties herein, and the use of the Image(s), State Stand-Ins and Submitted Information by Mississippi State Athletics and their display in any Production or Media.

- How many cutouts can I purchase?
- You may purchase up to 10 cutouts per Maroon Memories account. Please send each photo in an individual email within the same thread.
- Are there any restrictions to the photo I upload?
- Yes. Photos must be Mississippi-related, in good taste and not of a commercial nature. Mississippi State Athletics reserves the right to reject any photo that it determines, at its sole discretion. Fans will be notified if their photo is rejected and given an opportunity to resubmit if there is appropriate time prior to the deadline, but Mississippi State Athletics will not be obligated to provide the purchaser a refund if a submitted photo is rejected for any reason.
- Can two people be in one photo?
- Only 1 person per photo. Photos with multiple people will be rejected.
- Can I upload a photo of my pet?
- Of course!
- I uploaded the wrong photo can I upload a new one?
- We will do our best to accommodate requests to replace photos, but no guarantees can be provided on whether we'll be able to replace the photo before it goes to print.
- Will I know where my cutout is placed?
- Yes! When the photos are uploaded to Facebook they will be broken down by section. Due to limitations, not all sections and rows are available for this program and we cannot accommodate seat requests.
- How will I know if the photo I upload is accepted?
- We will send you confirmation of approval via email once your order has been confirmed. Please be patient as we process these orders and keep an eye out for any correspondence from Mississippi State Athletics.
- Will I be refunded if my photo is not approved?
- We will do our best to ensure you are given the opportunity to submit a new photo if your initial submission is rejected, but we cannot guarantee you will receive a refund should your photo be rejected.
- If I purchase more than one cutout will they be placed next to each other?
- While we cannot guarantee exact locations, we will do our best to seat multiple submissions together.
- Can I have my cutout at the end of the season?
- Yes! Depending on the package you purchased you will have an option to receive your cutout after the season has concluded. Please note, we cannot guarantee the condition of your cutout after exposure to weather and outdoor elements. You will be contacted at the email address or phone number provided when uploading your photo.
- What if the season gets canceled?
- All payments made to purchase cutouts are final and such payments shall not be refunded for any reason, including, but not limited to, the delay, suspension, cancellation, or early termination of the 2020 season
